Title III of the ADA has been interpreted by courts across the country to require accessible websites for businesses that serve the public, and WCAG 2.1 Level AA is the standard those courts most often reference. In April 2024, the Department of Justice formalized WCAG 2.1 AA as the rule for state and local government websites under Title II — a strong signal of where the standard is heading more broadly.
