Section 3
How We Share Your Information
We do not sell your personal information for money or other valuable consideration. Under the California Privacy Rights Act (CPRA), however, certain activities that benefit advertising partners can qualify as sharing personal information for cross-context behavioral advertising — even if no money changes hands.
Categories of recipients
- Service providers who process information on our behalf under contract — payment processors, shipping carriers, analytics tools, email/SMS platforms, our CRM (GoHighLevel), and our hosting provider (Hostinger)
- Advertising partners who receive Internet/Network Activity through tracking pixels (e.g., Meta Pixel, Google Ads) — this may constitute sharing under CPRA
- Legal recipients when required by court order, subpoena, or to comply with applicable law
- Business transfer recipients in the event of a merger, acquisition, financing, or sale of all or part of our assets
We do not knowingly sell or share personal information of consumers under 16 years of age.
Section 4
Data Retention
We retain personal information only as long as reasonably necessary for the purposes described in this policy, or as required by law. General retention periods:
- Inquiry & contact form submissions: up to 24 months from last interaction
- Customer records (orders, invoices, contracts): 7 years from last transaction, for tax and audit purposes
- Email marketing lists: until you unsubscribe, plus up to 90 days for suppression-list maintenance
- SMS marketing records: per TCPA, opt-in and opt-out records retained for at least 4 years
- Analytics (aggregated, non-identifying): retained per Google Analytics 4 default (currently 14 months)
- Server logs: 30 days unless extended for security investigation
Where information is no longer needed, we delete it or de-identify it so it can no longer be linked to you.
Section 5
Your Rights Under California Law (CCPA / CPRA)
If you are a California resident, you have the following rights:
- Right to know what personal information we have collected about you, the sources, the purposes, and the categories of third parties with whom we share it
- Right to delete personal information we have collected from you (subject to legal and operational exceptions)
- Right to correct inaccurate personal information we maintain about you
- Right to opt out of sale or sharing of personal information for cross-context behavioral advertising
- Right to limit use of sensitive personal information to that which is necessary to perform the services you requested
- Right to non-discrimination — we will not deny you services, charge different prices, or provide a different level of quality because you exercised any of these rights
- Right to data portability — receive a copy of your personal information in a portable format
To exercise any of these rights, see Your Privacy Choices below, email us at info@thebackyardbougie.com, or call us at (916) 232-7711. We will verify your identity using information we already have on file before fulfilling the request. Authorized agents may submit requests on your behalf with written authorization.
We will respond within 45 days. If we need more time (up to 90 days total), we will notify you in writing with the reason.
Section 6
Your Privacy Choices
You can exercise the following choices at any time, at no cost.
Opt out of sharing for cross-context behavioral advertising
Email us at info@thebackyardbougie.com with the subject line "Do Not Share My Personal Information" and we will suppress your data from advertising partners within 15 business days.
Global Privacy Control (GPC)
We honor the Global Privacy Control browser signal as a valid opt-out request, consistent with the California Attorney General's 2022 guidance. If your browser or extension transmits a GPC signal, we will automatically suppress ad-related tracking on this site for that browser, without requiring you to email us. Browsers and extensions that support GPC include Brave, DuckDuckGo, and Firefox with the Privacy Badger extension.
Marketing email opt-out
Click the unsubscribe link at the bottom of any marketing email, or reply with "unsubscribe."
SMS opt-out
Reply STOP to any text message you receive from us.
Cookies in your browser
You can clear, block, or manage cookies through your browser settings. Note that disabling cookies may degrade some site functionality.
Limit use of sensitive personal information
We do not currently use sensitive personal information (as defined by CPRA) for any purpose beyond providing the services you request. If this ever changes, this section will be updated and you will be given the option to limit such use.
Submitting a verifiable consumer request
For know, delete, correct, or portability requests, email info@thebackyardbougie.com with the subject "California Privacy Rights Request." Include enough information for us to verify your identity (e.g., the email address or phone number you have used with us).
Section 7
Cookies and Tracking Technologies
We use cookies, pixels, and similar technologies to operate the Site, measure performance, and (where consented) support advertising. Specifically:
Strictly necessary
- Session and security cookies required for the Site to function
- Form submission and CSRF protection
Analytics
- Google Analytics 4 via Google Tag Manager — measures aggregate traffic patterns, page performance, and content engagement. Configured with IP anonymization and standard retention.
Advertising
- Meta Pixel via Google Tag Manager — used for ad measurement and audience building on Facebook and Instagram. Suppressed when a Global Privacy Control signal is detected.
- Google Ads conversion tracking — fires only on conversion events. Suppressed under GPC.
How to control them
The first time you visit this site, a small notice asks you to accept or decline non-essential cookies. We use Klaro! — an open-source, self-hosted consent manager that does not itself collect data about your choices. You can change your selection any time by clicking Cookie preferences or by visiting Your Privacy Choices above.
You can also clear and block cookies through your browser settings, or use a browser that supports Global Privacy Control (Brave, DuckDuckGo, Firefox with Privacy Badger) to opt out of advertising-related tracking automatically.
Section 8
Data Security
We take reasonable measures to protect your information using administrative, technical, and physical safeguards. However, no method of transmission over the internet is 100% secure.
Section 9
Children's Privacy
Our Site is not intended for children under 13, and we do not knowingly collect personal information from minors.
Section 10
Third-Party Links
Our Site may contain links to third-party websites. We are not responsible for their privacy practices and encourage you to read their privacy policies.
Section 11
Changes to This Privacy Policy
We may update this policy from time to time. Changes will be posted on this page with an updated effective date.
